What are Free Downloads?
Free downloads do not mean “Free Beats“. Free downloads can be used for not-for-profit purposes and streaming via social networking websites (i.e. Youtube, Facebook, Myspace, Twitter, etc.). Free downloads do not have a distribution limit.
What is Leasing A Beat /Purchasing A Non- Exclusive License?
Blanket Licenses
Also known as non-exclusive rights, purchasing a lease grants the customer limited artistic & legislative rights to the corresponding beat for a single profitable commercial use on any medium (e.g. demo, album, EP, or mixtape) with a circulation of up to 4,000 sales units. If this point of sale is reached and further sales are desired, further rights with a new sales cap must be obtained (if exclusive rights to the instrumental have not been purchased). Leasing an instrumental does not make the leasee sole owner of the beat. The licensor retains 100% copyright and ownership of the original instrumental composition. In the event that someone buys exclusive rights to the beat you have leased, your rights shall stand until your sales cap is reached. Commercial Video, television, and radio airplay are strictly prohibited. Additionally, any re-sale, re-distribution or modification of the producer’s composition is expressly forbidden. Any re-selling, loaning, renting, leasing, assigning, remixing, re-arranging, removal of melodies, instruments, drum programming, transfer of any or all of the products sold or the corresponding rights to another person, or for use in a competitive product is prohibited.Licensee cannot use the beat composition as background elements in TV, Film &DVD, or computer game projects without a separate licensing agreement. Licensee agrees to display producers full name in all physical media or within web presentation of a portion (e.g. pre-listening) or sum of the original instrumental composition that is being licensed in this agreement. Used under license. Any displayed or downloadable mp3 files must include ‘produced by almostfreebeats.com’ within the file name. You must give full credit to ‘Zee of Almostfreebeats.com or Zee of AFB, LLC’ on all commercial recordings or if the sound bite/audio tag/sound mark in any recording says ‘The Brand’ credit must be given to ‘The Brand’.
Performance Licenses
Buying a non-exclusive performance license entitles you to the following:
- Right to use the beat for a song or simply background music for one (1) for-profit performance or concert with no limitation to earnings made in ticket sales or compensation.
Synchronization License
Buying a non-exclusive synchronization license entitles you to the following:
- Right to use the beat for soundtrack purposes for one (1) of the following commercial or for-profit mediums: motion picture, television show, television commercial, recorded video, music video, video game, website.
Will others be able to lease the same beat as me?
The answer is Yes. The leasing option (non-exclusive license) is great if you are on a stricter budget and plan to release independent material. It’s great to keep costs down and get a high return on your investment. It’s also great if you want to make money doing shows. The main limitation is that you can only distribute up to 4000 copies of your album with a leased beat or in the case of a synchronization/performance license the limitations are those listed above.
What are Exclusive Rights?
Exclusive rights grant the buyer an exclusive 1st use license of the beat they have purchased. Exclusive rights pricing is typically a lot steeper than lease pricing.Purchasing an exclusive first use license grants the customer full artistic & legislative rights to the corresponding beats for commercial use on any medium with no circulation limits or sales cap. Exclusive rights customers will receive an untagged (free of sound marks) instrumental, session files, and a signed producer artist agreement. The song file can be delivered digitally or through the mail on a CD. The licensor may no longer lease or sell the beat composition. Leasing rights sold prior to the sale of the exclusive first use license stand and remain valid until said sales cap is reached. Purchaser agrees to display producers full name in all physical media or within web presentation of a portion (e.g. pre-listening) or sum of the original instrumental composition that is being purchased in this agreement. This includes but is not limited to: Cd’s, Cd covers, cassette tapes, LP’s cards, etc. (Example: ‘produced by Almostfreebeats.com’ or ‘Music produced by The Brand’… Music © 2011 all rights reserved. You must give full credit to Zee of Almost Free Beats LLC or Zee of AFB, LLC on all commercial recordings or if the sound bite/audio tag/sound mark in any recording says “The Brand” credit must be given to The Brand. Customer and producer both sign an exclusive rights contract further detailing the
terms of service before instrumental and session files are delivered. Once payment is received for said instrumental AND contract is signed, the instrumental and all associated files will be delivered.
Why would I need exclusive rights?
Exclusive rights are for artists with a reasonable budget that plan on releasing a major/semi major project. This is a great option if you plan on distributing more than 4000 copies of your song.
